The way these services are delivered is well provided in the Constitution and in various legislations.<\/p><p class=\"TX_Lato_150\">Cumulative evidence suggests that non-state security actors are sometimes more effective than state security actors in the delivery of security, safety and justice, particularly in the countries that are<a class=\"nonblock\" href=\"https:\/\/www.oecd.org\/dac\/conflict-fragility-resilience\/docs\/38434642.pdf\" target=\"_blank\" rel=\"noopener\">\u00a0fragile or emerging from conflict<\/a>, as the presence of state security actors is weak, particularly in rural settings. Besides the\u00a0<a href=\"https:\/\/www.peaceau.org\/uploads\/au-policy-framework-on-security-sector-reform-ae-ssr.pdf\"><span class=\"s1\">recognition of the African Union<\/span><\/a>\u00a0of the role of the non-state actors in security sector governance, there is a legal framework in South Sudan within which the non-state actors could provide security, safety and justice services:<\/p><h4 class=\"p3\"><b>The Constitution<\/b><\/h4><p class=\"p2\">The 2011\u00a0<a href=\"https:\/\/faolex.fao.org\/docs\/pdf\/ssd182397.pdf\"><span class=\"s1\">Transitional Constitution of the Republic of South Sudan<\/span><\/a>\u00a0provides the following provision in recognition of non-state actors and informal institutions such as traditional authorities that are critical for the provision of conflict resolutions, peace, social order and justice:<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-f83da9a elementor-widget elementor-widget-image\" data-id=\"f83da9a\" data-element_type=\"widget\" data-widget_type=\"image.default\">\n\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t<img fetchpriority=\"high\" decoding=\"async\" width=\"579\" height=\"237\" src=\"https:\/\/africansecuritynetwork.org\/HSGO4\/wp-content\/uploads\/2024\/12\/ss_n-state-constitution_graph.png\" class=\"attachment-large size-large wp-image-738\" alt=\"\" srcset=\"https:\/\/africansecuritynetwork.org\/HSGO4\/wp-content\/uploads\/2024\/12\/ss_n-state-constitution_graph.png 579w, https:\/\/africansecuritynetwork.org\/HSGO4\/wp-content\/uploads\/2024\/12\/ss_n-state-constitution_graph-300x123.png 300w\" sizes=\"(max-width: 579px) 100vw, 579px\" \/>\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-fcab24e elementor-widget elementor-widget-text-editor\" data-id=\"fcab24e\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<h4 class=\"p1\"><b>The Local Government Act<\/b><\/h4><p class=\"p2\">The 2009\u00a0<a href=\"https:\/\/docs.southsudanngoforum.org\/sites\/default\/files\/2017-09\/Local%20Government%20Act%202009.pdf\"><span class=\"s1\">Local Government Act<\/span><\/a>\u00a0provides detailed provisions regarding the implementation of constitutional provisions. Traditional authority systems, customary law courts and their independence, status, and types of traditional authorities, composition, criteria for the establishment of decentralized chiefdoms, election or selection of chiefs and immunity of kings and chiefs are detailed in the following chapters:<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-b24e582 elementor-widget elementor-widget-image\" data-id=\"b24e582\" data-element_type=\"widget\" data-widget_type=\"image.default\">\n\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t<img decoding=\"async\" width=\"722\" height=\"141\" src=\"https:\/\/africansecuritynetwork.org\/HSGO4\/wp-content\/uploads\/2024\/12\/ss_n-state-the-local-government-act_graph.png\" class=\"attachment-large size-large wp-image-740\" alt=\"\" srcset=\"https:\/\/africansecuritynetwork.org\/HSGO4\/wp-content\/uploads\/2024\/12\/ss_n-state-the-local-government-act_graph.png 722w, https:\/\/africansecuritynetwork.org\/HSGO4\/wp-content\/uploads\/2024\/12\/ss_n-state-the-local-government-act_graph-300x59.png 300w\" sizes=\"(max-width: 722px) 100vw, 722px\" \/>\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-ee00dfc elementor-widget elementor-widget-text-editor\" data-id=\"ee00dfc\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<h4 class=\"p1\"><b>South Sudan Police Service Act<\/b><\/h4><p class=\"p2\">The\u00a0<a href=\"https:\/\/mofaic.gov.ss\/wp-content\/uploads\/2023\/03\/Southern-Sudan-Police-Service-Act-2009.pdf\"><span class=\"s1\">Police Act<\/span><\/a>\u00a0provides for the establishment of community policing \u201cto help the Police Service in the performance of its functions and duties and to mobilize the people for the preservation of law and order\u201d.
